DRUM RIFF Terms of Use

These Terms of Use (these "Terms") set out the conditions for using the iPhone and iPad application "DRUM RIFF" (the "App") provided by hiroyuki sadamatsu（屋号：Pin Games） (the "Operator"). By downloading or using the App, you agree to be bound by these Terms.

1. Scope

These Terms apply to all relations between the Operator and users in connection with the use of the App.

2. Fees

The App is free to download and includes storage for 10 songs. In-app purchases add 20 permanent slots or unlock unlimited song storage. Each can be purchased once. If you have purchased 20 extra slots, you can upgrade to unlimited storage at a price reflecting that purchase. Deleting a song frees its slot. Prices are displayed before purchase and vary by region. Purchases and refunds are handled through Apple. Restore purchases using the Apple Account used for purchase. Revoked purchases reduce storage or upgrade entitlements; existing songs are not automatically deleted.

3. User Responsibility

• You may only import content into the App that you have the right to use, including with respect to copyright and other rights.
• You are responsible for all content you input into the App, including chart data.

4. Prohibited Conduct

You must not, in connection with your use of the App:

• Violate any applicable law or public order and morals;
• Infringe the intellectual property rights, rights of publicity, privacy rights, or other rights of the Operator or any third party;
• Reverse-engineer, decompile, or disassemble the App, except as permitted by law;
• Interfere with the operation of the App.

5. Disclaimer of Warranty

• The Operator makes no express or implied warranty that the App is free of factual or legal defects (including, without limitation, defects, errors, or bugs related to safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, or security, or any infringement of rights).

6. Limitation of Liability

The Operator shall not be liable for any damages arising from your use of the App, except where such damages result from the Operator's willful misconduct or gross negligence.

7. Changes to These Terms

The Operator may change these Terms without individually notifying users, where the Operator considers it necessary. The revised Terms take effect once announced within the App or by another method the Operator determines.

8. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. Any dispute arising in connection with the App shall be subject to the exclusive agreed jurisdiction of the Tokyo District Court as the court of first instance.
